lawsuit
related to its
Pixel
smartphones. According to a report by Law360, plaintiff
Jennifer Hyatt
has filed a class action lawsuit against Google over the Pixel 6 Pro. The lawsuit alleges that the tech giant knew the
Pixel 6 Pro
smartphone had a defect that caused it to become too hot to hold.
The plaintiff also noted that she replaced her Pixel 6 Pros “numerous” times only to discover that each one had an overheating defect.
Hyatt believes this was not just some coincidence and Google was aware of the issue before it started selling the handset. Yet, the company continued to sell the devices without providing any warning to consumers.
Hyatt’s lawsuit also argues that Google needs to create an advertisement that will inform consumers about this issue. In addition, the plaintiff wants the company to recall the smartphone and issue refunds to those who purchased the device.
This lawsuit was filed in California and Hyatt reportedly wants to represent a class of consumers from the US state. If the lawsuit goes forward, it will claim that Google violates California’s Consumers Legal Remedies Act, False Advertising Law, Unfair Competition Law and the Song-Beverly Consumer Warranty Act.
What this means for Google
However, it’s important to note that the filing is just the initial phase of a class action lawsuit. To make it to trial, Hyatt’s lawsuit will need to go through a variety of hurdles before anything happens. The US court may even dismiss the lawsuit at its filing stage.
In 2023, Google faced a separate lawsuit for making misleading claims about its Pixel smartphones. The lawsuit noted that the company made misleading claims about the charging capabilities of both Pixel 6 and Pixel 6 Pro.
