NEW YORK (PIX11) -- Dunkin' is being sued for $5 million for charging more for non-dairy alternatives, according to a class action suit.
The suit claims the higher prices on milk alternatives are exclusionary and a form of discrimination. The extra charges for milk alternatives can be over two dollars.
The suit also accuses Dunkin' of violating the Americans with Disabilities Act. For those who are lactose intolerant-- it's medically necessary to avoid milk.
The lawsuit also states the company does not charge extra for other customizations like removing sugar for people with diabetes and caffeine for people with hypertension.
